1.1. Site owner

1.2. Purpose

This notice governs access to and use of this website and participation in the raffles published on it. Using the site implies acceptance of these terms.

1.3. Conditions of use

• You must be over 18 and legally able to enter into contracts.
• You agree to provide truthful details. False details may void your participation.
• Your chosen alias is public. Offensive, impersonating or personal-data aliases are not allowed and may be edited or removed.
• Any unlawful use of the site, attempts to access restricted areas, disrupt its operation or inject malicious code are forbidden.
• The owner may suspend the service temporarily for maintenance or technical reasons, with no right to compensation.

1.4. Raffle terms

The specific rules of each raffle (number price, prize, date, shipping and refunds) are set out on the shipping & terms page, which forms an inseparable part of this notice. In short:

• Each raffle has 100 numbers, 00 to 99, at the price published on the home page.
• The winner is decided by the last two digits of the ONCE Cupón Diario on the date shown. It is a public, verifiable draw unrelated to this site.
• This website has no affiliation with ONCE and is neither sponsored nor endorsed by it. Its draw is used solely as a public method for determining the winning number.
• The main prize is included in the number price. The winner may swap it for another catalogue prize paying the value difference.
• Prizes cannot be exchanged for cash.
• If not all 100 numbers are sold, the raffle is postponed or refunds are issued, as detailed in the terms.

1.5. Gambling regulations

Paid raffles may fall under Spanish Law 13/2011 on gambling regulation and regional legislation, which in certain cases require prior administrative authorisation. The owner declares responsibility for holding whatever authorisations apply to this activity.

1.6. Intellectual property

The texts, photographs, design and code of this site belong to [PENDIENTE: nombre o razón social] or are used with permission. Reproduction or distribution without express written consent is forbidden.

1.7. Liability

• The owner is not liable for damage caused by misuse of the site or interruptions beyond its control.
• Prizes are live plants or seeds. The exact specimen may reasonably differ from the photo in size, leaf count and shape.
• Transport damage is not covered when not reported within the period stated in the shipping terms.

1.8. Third-party links

This site may link to third-party websites (e.g. the payment gateway or social networks). The owner does not control their content or privacy policies and accepts no liability for them.

2. Privacy policy

Under Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018:

2.1. Data controller

No special-category data is processed. We never store your card details: the payment gateway handles them directly.

2.4. What is public and what is not

The raffle grid publicly shows only the alias you choose, next to your numbers. Your real name, email, phone and address are never published. Feel free to use a nickname.

2.5. Who receives your data

• Payment gateway: to process card payments, as an independent controller.
• Courier: only if you win, and only what is needed for delivery.
• Hosting provider: as processor, under an Art. 28 GDPR agreement.
• Public authorities: where legally required.

Your data is never sold or shared for marketing.

2.6. International transfers

Some technology providers may be located outside the EEA. Transfers rely on EU Standard Contractual Clauses or an adequacy decision.

2.7. Retention

• Raffle and order data: for the raffle and then for the legal limitation periods of tax and commercial obligations (up to 6 years).
• Published alias: visible while the raffle remains published, as a transparency record.
• Email enquiries: up to one year after resolution.
• Security logs: up to 12 months.

2.8. Your rights

You may exercise at any time your rights of access, rectification, erasure, objection, restriction, portability and to withdraw consent, by writing to hola@marinasjunglegems.com with proof of identity. We reply within one month. You may also complain to the Spanish Data Protection Agency (www.aepd.es).

2.9. Security

We apply appropriate technical and organisational measures: TLS encryption, admin access control with attempt limits, firewall, daily server backups and automatic security updates. In the event of a breach posing a risk to your rights, we will inform you and notify the supervisory authority under Articles 33–34 GDPR.

2.10. Minors

This site is not aimed at under-18s, who may not take part. Any data of a minor we detect will be deleted.

3. Cookie policy

This site uses a single technical, strictly necessary cookie:

We use no analytics, advertising, profiling or third-party cookies. Being strictly necessary, this cookie is exempt from prior consent under Art. 22.2 LSSI-CE, which is why you see no cookie banner. (A second first-party cookie stores your language choice if you switch languages — equally technical.)

4. Disputes

These terms are governed by Spanish law. Any dispute falls to the courts of the consumer's place of residence. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

5. Changes

The owner may update this notice for legal or operational reasons. The current version is always the one published here, with its date shown above. Changes never affect raffles already under way.
